U Visa and Green Card Pathway

U visa holders who have been in the United States for at least three years may be eligible to apply for a green card.

U visa holders who file Form I-485 to adjust status must meet the standard adjustment of status requirements, including completing an immigration medical examination with a USCIS-designated civil surgeon.

Medical Exam Requirement

All I-485 applicants, including U visa holders, must complete an immigration medical examination with a USCIS-designated civil surgeon and submit Form I-693. The medical exam requirement applies regardless of the basis for the I-485 application.

The civil surgeon is bound by HIPAA and professional confidentiality obligations. Your medical information will not be shared with anyone other than USCIS without your consent.

What the Exam Covers

The immigration medical exam covers a complete physical examination, tuberculosis testing, required laboratory tests, and a vaccination review. The civil surgeon will administer any missing required vaccines.

You are not required to disclose the details of the crime you experienced to the civil surgeon. Simply tell them you are filing Form I-485. The civil surgeon evaluates your medical fitness for immigration purposes only.

Sensitivity Considerations

A good civil surgeon will approach the exam with sensitivity and respect. If you have experienced trauma related to the crime, you can let the civil surgeon know that you prefer a trauma-informed approach. You can also bring a support person or advocate.

If you have injuries or physical conditions related to the crime, you are not required to disclose the cause to the civil surgeon. The civil surgeon will document observable medical findings as required.

Confidentiality

The civil surgeon's office is bound by HIPAA privacy rules. Your medical information will not be shared with the perpetrator of the crime or anyone else without your consent, except as required by law. If you have concerns about privacy, contact the civil surgeon's office before your appointment to discuss their privacy practices.

Practical Tips for U Visa Holders

Bring your Form I-94, passport or other identity documents, vaccination records, and any relevant medical records to the appointment. If you need language assistance, contact the civil surgeon's office in advance. Many civil surgeon offices can accommodate language needs or you can bring a trusted interpreter.
