HRIFA Overview

The Haitian Refugee Immigration Fairness Act (HRIFA) of 1998 provided immigration relief to certain Haitian nationals who had been in the United States since December 31, 1995. HRIFA allowed eligible Haitians to apply for lawful permanent residence without the usual immigrant visa requirements.

HRIFA applicants who file Form I-485 must meet the standard adjustment of status requirements, including completing an immigration medical examination.

Medical Exam Requirement

All I-485 applicants, including HRIFA applicants, must complete an immigration medical examination with a USCIS-designated civil surgeon and submit Form I-693. The medical exam requirement applies regardless of the basis for the I-485 application.

HRIFA applicants who have been in the United States for many years may have limited vaccination records from Haiti. The civil surgeon will review available records and administer any missing required vaccines.

What the Exam Covers

The immigration medical exam covers a complete physical examination, tuberculosis testing, required laboratory tests, and a vaccination review. The civil surgeon will administer any missing required vaccines.

There are no special medical requirements for HRIFA applicants. The exam is the same as for any other I-485 applicant.

Haitian Vaccination Records

Many Haitian nationals have limited vaccination records. Haiti has faced significant public health challenges, and vaccination records may be incomplete or unavailable. If you do not have vaccination records, the civil surgeon can administer the required vaccines at the appointment.

Bring whatever vaccination records you have, including records from U.S. healthcare providers if you have received vaccinations in the United States.

TB Testing

Haiti has a higher TB prevalence than the United States. All I-485 applicants must be tested for TB. If your TB test is positive, the civil surgeon will order a chest X-ray.

A positive TB test does not automatically disqualify you from obtaining a green card, but you may need to complete treatment. The civil surgeon will guide you through the next steps.

Practical Tips and Resources

Bring your identity documents, vaccination records, and any relevant medical records. If you need language assistance (Haitian Creole or French), contact the civil surgeon's office in advance. Many Haitian community organizations can help you navigate the immigration process.
